The Humanside Inc. (“HumanSide,” “we,” or other applicable first-person pronouns) is providing this Privacy Notice and the Cookie Notice (collectively, the “Notice”) to explain how we collect, use, disclose, safeguard, transfer, access, dispose of, and otherwise process (collectively, “Process”) Personal Information (defined below) we collect. For example, this Notice covers:

Personal Information we collect when you interact with our official accounts on social media;
Your communications with us via webconference, phone, email, text, and other forms of electronic messages;
The services we provide our customers;

As such, this Privacy Notice does not apply to:
Information that is not Personal Information, including anonymous, de-identified, or aggregated data, even if it was derived from Personal Information.

Personal Information that is collected by any third party. Those third parties have their own privacy practices, and we encourage you to review them, especially by reading any available privacy notices, before providing Personal Information to or through them.
Personal Information we collect about employees or job applicants.
We may provide additional or supplemental privacy notices for specific products or Services that we offer. Unless otherwise noted, those supplemental notices should be read together with this Notice. In the event of a conflict or inconsistency between this Notice and any supplemental privacy notice, the supplemental privacy notice controls.
Changes to this Privacy Notice
HumanSide may update to this Notice from time to time to account for changes in our Processing of Personal Information. We will revise the date found at the beginning of this Notice when we make changes to it. If we make material changes to this Notice, we will notify you and provide you an opportunity to review before you choose to continue using our services.
Children’s Information
HumanSide’s Services are not intended for or directed to minors. If you are minor, please do not visit the Site, use our Services, engage with us on social media, or otherwise provide us any information. If we learn that we are Processing a minor’s Personal Information, we will take additional steps to ensure we are complying with any applicable legal requirement.
Personal Information We Collect about You
For the purposes of this Notice, “Personal Information” is broadly defined to mean information that can identify an individual directly or indirectly through reasonably available information and includes the definitions of “personal information,” “personally identifiable information”, “personal data,” and other analogous terms under applicable data protection laws. General location information derived from your Internet Protocol address, such as city, state, and country.

When we combine information we learn about you that is not Personal Information (information related to your preferences or information collected automatically, described below) with Personal Information we have collected about you, we treat those inferences as Personal Information.
Sensitive Personal Information
HumanSide may use AI assistants in our meetings with you, and these AI assistants may use your biometric information to enhance their services. This biometric information may be considered sensitive under some laws. Therefore, the Sensitive Personal Information that we may have collected from you in the last 12 months is biometric information, specifically, voiceprints

The Personal Information HumanSide collects depends on how you interact with us and which Services we are providing.

We collect Personal Information directly from you, for example:
You may provide Personal Information when you correspond with us by email, phone, text messaging, or otherwise; contact us through the Site; complete forms or surveys; interact with our social media accounts; or engage with us at an in-person event.

Providing the Services. If your employer has contracted with us for Services, we may share information we have collected about you in the course of providing those Services. This includes processing payments and managing billing and financial records.
Service providers. We disclose your information to service providers we use to support our business, and which are bound by contractual obligations to keep Personal Information confidential and secure and use it only for the purposes for which we disclose it to them.

HumanSide does not engage in sales, sharing, or targeted advertising using Personal Information about minors.
Profiling
For the purposes of this Privacy Notice, "profiling" means any form of automated processing of Personal Information to evaluate, analyze, or predict personal aspects concerning your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.
HumanSide does not engage in profiling that produces legal or similarly significant effects. However, targeted advertising may be “profiling” under some laws.
How to Opt Out of Sales, Sharing, Targeted Advertising, and Profiling
You may opt out of the activities we engage in that constitute “sales,” “sharing,” “targeted advertising,” or “profiling” by clicking the "Do Not Sell or Share My Personal Information" link on the footer of our Site. HumanSide strives to provide you with choices regarding your Personal Information. We have created mechanisms to provide you with the following control over your information:

We will not discriminate against you because you exercise these rights, but the deletion or cessation of collection of information may result in cancellation of Services initially provided to you or our inability to provide Services to you.
Shine the Light Law
California's "Shine the Light" law permits consumers that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Please note, we do not disclose your Personal Information to third parties for their direct marketing purposes.
Exercising Your Rights

Please note that you will need to verify your identity before we can fulfill your request. Your request must: 1. provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person; and 2. describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. We will respond to your verifiable request within any prescribed timelines. In some jurisdictions, there may be limitations on how often a request relating to Personal Information may be submitted.
Appointing an Authorized Agent
You may designate an authorized agent to submit a request on your behalf, subject to proof of identity and written authorization as required under the applicable privacy law. As part of our verification process, we may request that the agent provide, as applicable, proof concerning their status as an authorized agent. In addition, we may require that you verify your identity as described above or confirm that you provided the agent permission to submit the request.

Data Retention
Except as otherwise permitted or required by applicable law or regulation, HumanSide will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. To determine the appropriate retention period for Personal Information, we consider applicable legal requirements, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we Process your Personal Information, and whether we can achieve those purposes through other means.
Data Security
HumanSide uses physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, use, alteration, or disclosure. We require service providers to maintain data protections consistent with the amount, nature, and sensitivity of the Personal Information they are Processing and best practices. We do not guarantee that our safeguards will always work.
The safety and security of your information also depends on you. We urge you to take care when providing information that is available to the public, such as reviews or on our social media pages.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to us. Any transmission of Personal Information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures.
